This important discussion focused on two recent articles published in Volume 86, Issue 3 of the ABA's Antitrust Law Journal

The first article, by the Lab's founder Aurelien Portuese, is entitled "Dynamic Competition as a Double-Edged Sword: An Antitrust Primer" and provides a primer on the concept of dynamic competition as a double-edged sword in antitrust analysis.

The second article, co-authored by Lab senior fellow Jorge Padilla, Senior Circuit Judge Douglas Ginsburg, and Jones-Day partner Koren Wong-Ervin, uses empirical evidence to examine the extent to which antitrust agencies should adapt the legal standards—namely, static concentration measures—for analyzing dynamically competitive industries.
