As parties race for favorable venues and block infringement actions, this trend risks worsening trade fragmentation, exemplified by the ongoing EU-China WTO dispute. The paper suggests the TRIPS Agreement as a solution to counter antitrust protectionism and prevent abuse of enforcement practices
